THE ONE THAT GOT AWAY
An Analysis of Federal Regulation
of the Release of
Genetically Engineered Fish
Anthony G. Gorski
I. INTRODUCTION
Biotechnology' is the brain child of modern science. Its discoveries and
advances have the potential to solve medical mysteries, alleviate world
hunger, and help rid our planet of its pollution burden. It also has the
potential, if unregulated, to cause environmental and health problems.
Institutions and industry combine genes from various plants, animals,
microbes, and viruses to produce novel organisms for use in the areas of
agriculture, pharmaceutics, food production, and other areas, with one of the
major focuses on the creation of genetically engineered fish. The biotechno-
logical interest in fish ranges from sport fish such as the pike, to food fish
such as the channel catfish, to the biological control of weeds through the use
of the grass carp. Scientists using biotechnology are splicing genes from
different organisms into fish to create species that are bigger, stronger, and
better. The ultimate goal of such experiments is clear: to release these fish
into the environment for food, sport, and other uses.
t Anthony Gorski received his J.D. and a Master's degree in Environmental Law from
Vermont Law School in 1990. He is currently an Assistant Attorney General with the
Office of the Attorney General, Maryland Department of the Environment.
1. Biotechnology, as used in this analysis, refers to the manipulation, transfer,
duplication, or deletion of genetic sequences of the DNA of living organisms for
human purposes.
