America's War on Infidelity: A Call for
the Revamping, Reviving, and Reworking
of Criminal Conversation and
Alienation of Affections

On March 10, 2008, news broke that New York State Governor
Eliot Spitzer was involved in a prostitution scandal.' As the details
unfolded, the public learned that Spitzer, the then forty-nine year old,
married governor of New York, had been having an extramarital af-
fair with a twenty-two year old female escort from the Emperor's
Club VIP prostitution ring. Spitzer later resigned during a public
news conference.2 Many were shocked and appalled at this discovery.
But the question remained, what exactly shocked them? One can
point to many details of this story that run counter to societal values:
for example, the over twenty-year age difference between the two par-
ties and Spitzer's status as a notable political figure who quite possibly
used taxpayers' dollars to fund his adultery. A particularly troubling
piece of the story, however, was the prostitution aspect. The buying
and selling of sex is considered wrong to the extent that the law in
