Constitutional Right to Healthy Environment as a
Panacea for Sustainable Development in Nigeria

       Abstract
Recognition of a right to a healthy environment
remains paramount to the achievement of
       Sustainable Development Goals. Unfortunately,
despite the importance of this right, it has only
       gained some relevance internationally and
remained unknown in most developing countries.
While international law has through its norms,
courts and commissions on human rights
contributed to the development of the right to a
healthy environment, the fact remains that nation
states have the responsibility to protect and uphold
       environmental rightsthe Constitution remains a
viable tool for the realisation of such right. The
Constitution of the Federal Republic of
       Nigerial999 (as amended) provides for
environmental objectives which the government is
to only strive to achieve. Beyond this, the key
questions which this article seeks to answer are
what happen in cases of harm or threat of harm to
the environment? Can individuals or non-
governmental organizations readily have access to
the courts to challenge a wrong which has been
done to the environment or complain that their
rights to clean air, water etc, have been violated by
indudtrial activities resulting from pollution? It is
against this background that this article examines
the right to a healthy environment, its relevance
and challenges to its recognition in Nigeria.
