       The Right to Housing in Spain:
                A Cautionary Tale

Abstract

It is well-known that the housing bubble burst led to a deep crisis of the housing
market in Spain. In this regard, the article analyses the answers provided by the
Spanish Constitutional Court to both the abusive mortgage contracts' terms and
the vulnerable groups' evictions. Due account is given to the case law of both the
Court of Justice of the European Union and the European Court of Human Rights.
Furthermore, the link between the financial crisis and the housing crisis is critically
analysed. The final aim is to inquire into the domestic protection of the right not to
lose one's home and the right to housing, and housing as an investment asset.

Resumen

El estallido de la burbuja inmobiliaria provoc6 una grave crisis en el mercado de
vivienda en Espaha. Partiendo de este dato conocido, elpresente trabajo estudia la
respuesta que el Tribunal Constitucional Espahol ha dado tanto a las cldusulas
hipotecarias abusivas como a los desahucios de colectivos vulnerables. Con este fin
se estudia, de una parte, la influencia que podria tenerjurisprudencia del Tribunal
de Justicia de la Uni6n Europea y del Tribunal Europeo de Derechos Humanos. De
otra parte, se estudia el vinculo entre la crisis la crisis financiera y la crisis del
mercado de vivienda. El objetivo final es debatir la protecci6n de la vivienda como
derechofundamentalfrente a la vivienda como activofinanciero.
