A New Marine Biodiversity Treaty?

Dr. Cristina Elena POPA TACHE1 Motto: ,,Nimic nu este convenit pdna cdnd nu se convine totul2 Abstract According to the High Seas Alliance, on 24 December 2017, the UN General Assembly adopted by consensus Resolution 72/249, to convene an intergovernmental conference and undertake formal negotiations for a new legally binding international instrument under the UN Convention on Law of the Sea, for the conservation and sustainable development of marine biological diversity in areas beyond national jurisdiction. In this way, the common heritage of humanity has a good chance of being protected and secured, the convention being in fact the arm which has the noble role of saving it from danger. When will it be signed? How will it be implemented? Will its noble purpose overcome the blockages of financial interests? These are questions to be answered by the legal doctrine and practice of the future. To create this article, I used a research method based on introspection and quantitative analysis of the documents related to the rounds of negotiations, by reference to international law.
