After the end of the Cold War, and with the advent of the era that
Fukuyama termed The End of History,1 there has been a tendency
for constitutions in many countries around the world to develop
similarities one to another.2 Recognition of this tendency is supported
by research carried out by David Law and Mila Versteeg, which shows
that, currently, most constitutions have been adopting an increasing
number of rights, usually accompanied by a mechanism of judicial
review to implement these rights.3 This gives rise to a phenomenon
