  * This article is a modified version of Chapter III of a dissertation submitted to the
University of London (University College) as a requirement for the Ph.D. degree in Law and
Social Theory. The revision was made possible, in part, by a Summer Initiative grant from
the University of Puerto Rico. The original version was discussed in a Faculty Seminar at
the University of Puerto Rico School of Law. The author thanks Marta Santiago Ramos, a
former third year student at the University of Puerto Rico School of Law, who provided

converting the citations from the Social Science format of the original to the law review
