     ABSTRACT
     Hitherto, when analysing causation, legal scholars have mostly concentrated on violent crimes. Although
this type of approach is understandable, it can still raise significant issues when verifying causation in the case
of public office crimes. Nevertheless, establishing causation remains essential, even when dealing with this
type of misconduct. The first part of this series concentrates on questions of general theory of causation. It also
contains a brief analysis of the public office crimes. In part, it focuses on a thorough analysis of causation in the
case of omissions. It also proposes a model to adapt some rules derived from common law theory and practice
to the objective imputation theory. The second part of the study, which will be published in another number
will build upon these principles and apply them to concrete situations, found in legal practice.

      REZUMAT
      Adesea, exemplele folosite pentru a ilustra raportul de cauzalitate in materie penald se concentreazd
pe infractiunile violente, contra vietii sau integritdtii fizice. Desi aceastd abordare este de inteles, poate ridica
probleme atunci cand ne raportdm la infractiuni de rezultat cu o naturd complet distinctd, precum abuzul sau
neglijenta in serviciu. Fdrd de indoiald, insd, stabilirea cauzalitdtii, ca element de tipicitate rdmdne esentiald si
in aceastd materie. Prima parte a prezentului studiu vizeazd probleme ce tin de teoria generald a cauzalitdtii si
o succintd analizd a celor doud infractiuni. Elementele de noutate constau intr-o analizd aprofundatd asupra
cauzalitdtii in cazul omisiunilor si o tentativd de a adapta o serie de reguli din practica instantelor din sistemul
common law in materia imputdrii obiective. Cea de-a doua parte, care va fi publicatd ulterior, va prelua aceste
principii si le va aplica la situatii concrete, din practica judiciard.
