I. BACKGROUND AND INTRODUCTION
The U.S. Supreme Court's recent designation of greenhouse gases (GHGs) as pol-
lutants and the U.S. Environmental Protection Agency's (EPA) subsequent decision
to regulate them is bound to have a number of far-reaching impacts in Texas. The
most immediate impact is the enactment of legislation designed to address man-made
(anthropogenic) carbon dioxide, a GHG, which the EPA now views as harmful to hu-
man health.1 The EPA's endangerment finding will result in GHG regulation under
I    EPA Endangerment and Cause or Contribute Findings for Greenhouse Gases Under Section
202(a) of the Clean Air Act, 74 Fed. Reg. 66495, 66496 (Dec. 15, 2009) (to be codified at
4 C.F.R. ch. 1) (this endangerment finding is being appealed in EPA Docket No. EPA-HQ-
OAR-2009-0171, In re Endangerment and Cause or Contribute Findings for Greenhouse Gases Under
Section 202(a) of the Clean Air Act, before the United States Environmental Protection Agency
(Petition for Reconsideration filed on or about 2/16/10), and Cause No. 09-1322, Coalition
for Responsible Regulation, Inc. v. United States Environmental Protection Agency, in the United
States Court of Appeals for the District of Columbia Circuit. Note: while the endangerment
finding is on appeal, the EPA has, nonetheless, moved forward, making a final rule regarding
