I.   INTRODUCTION
It is no secret that foreign shipowners are often averse to
defending seamen's personal injury lawsuits in the United States. If,
at the time a crew's employment commences, a shipowner can obtain
agreements from crewmembers that all controversies arising out of
their employment will be adjudicated in a particular non-U.S. forum,
the shipowner can hope to reduce significantly its exposure to tort
liability and burdensome legal expense. This is because most foreign
forums do not offer plaintiffs the exorbitant personal injury judgments
