Conceiving a Code for Creation:
The Legal Debate Surrounding
Human Cloning
by
NICOLE M. NEMIROFSKY and JOHN D. MINTON
SENIOR SYMPOSIUM EDITORS
On January 26,2002 the Hastings Law Journal held a symposium
addressing the legal debate surrounding cloning in an era when
human cloning is on the brink of possibility.
Human cloning, once far off fantasy, may rapidly become reality
as proponents claim to possess the will and ability to clone a human
being. This development not only presents complex legal and
philosophical questions, but has also prompted a flurry of legislative
action at both the state and federal levels. Last year, the House of
Representatives made headlines by passing a dramatic ban on all
forms of human cloning. Several states have also entered the fray; in
California, the current moratorium on human cloning is nearing
expiration and the legislature will soon decide whether to continue or
alter the prohibition. This issue of the Hastings Law Journal contains
articles and a transcript from the two symposium panels.
We would like to thank Hastings Professor Radhika Rao for her
assistance in organizing the event. We are also very thankful for all of
the support we received from local law firms and businesses, Hastings
faculty and staff, Hastings Law Journal members, particularly Jeanne
McKinney, and the staff of the O'Brien Center for Scholarly
Publications.
