   * Pamela Herd is a professor at Georgetown University, Donald Moynihan is a professor
at Georgetown University, and Amy Widman is a professor at Rutgers Law School. This
Article is based on a report prepared for the consideration of the Administrative Conference
of the United States (ACUS). PAMELA HERD, DONALD MOYNIHAN & AMY WIDMAN,
IDENTIFYLNG AND REDUCLNG BURDENS IN ADMINISTRATIVE PROCESSES (Dec. 5, 2023) (re-
port to the Admin. Conf. of the U.S.). Further, this Article draws from our research as aca-
demic consultants to the ACUS, which adopted Recommendation 2023-6, Identifying and
Reducing Burdens in Administrative Processes. See Adoption of Recommendation, 89 Fed.
Reg. 1,509 (Jan. 10, 2024). As with the earlier report, this Article represents the views of the
authors and not necessarily those of the ACUS, its Council, members or committees, or the
federal government. The authors would also like to recognize the assistance of ACUS staff
and management, and Eloise Pasachoff and members of the ACUS Committee on Admin-
istration and Management. Special thanks Matthew Gluth for his guidance throughout this
project. We also express appreciation to the staff members of agencies who furnished inter-
view data about burdens. We have protected their anonymity. Mario Bennetti and Frederick
Davis provided outstanding research assistance on this project, and we thank the editors at
the Adminisative Law Review as well.
