Some probation officers are leaving their traditional counseling role to
become brokers of community resources.
The rapid pace at which misdemeanor cases
are processed does not relax with a plea or
finding of guilty. Sentencing in these courts
usually occurs a few moments later. The
misdemeanant is fined, placed on probation,
sent to jail, or released with a jail sentence
suspended.
The decision between jail and probation is
often made by the judge without the help of
a probation department presentence investi-
gation. In many misdemeanor courts, there
is no probation service; in others, probation
officers struggle with impossibly heavy case-
loads.
Misdemeanants form the largest portion
of the offender population, but they are the
group for whom the fewest and poorest
probation services are available. This anom-
aly is usually explained on the ground that
misdemeanants are not dangerous to the
community. But they are a major factor in
the national crime problem: they tend to be
repeaters; they tend to present significant
adjustment problems; in some jurisdictions
they are jailed more frequently than felony
offenders;1 and they account for a large
expenditure of public funds. Clearly, an
