    Abstract
    Copying   words   or  ideas from   someone   else's scientific work is
considered plagiarism,  the exception in this matter being provided by the
Romanian   Law  on  copyright and related rights where it is stated that the
use  of brief excerpts from a  work  for the purpose  of an  examination,
commentary,   criticism, or exemplification, to the extent to which their use
justifies the extent of the quotation, is permitted  without the  author's
consent, insofar as  the quoted fragment   is attributed by citation to its
original source. However there are circumstances when indicating the
source  is not customary as it would interfere with the natural flow of the
text. On the other hand authors have a moral obligation to credit those who
influenced their work and to avoid redundant  quotation. Last but not least,
especially in the legal domain,  what  can  really make  a scientific work
original and worthy  of attention is weaving together the ideas and words of
others with the author's own vision over a given topic.

    Oricare cercetitor, mai devreme sau mai tirziu, se confruntg cu spinoasa
chestiune a necesititii de a cita pasaje din opere deja aduse la cunoptinta
publicului, in scopul de a-§i desiviri propria contributie la progresul §tiintei
al cirei servitor este.
    In  mod  fericit, Legea privind dreptul de autor §i drepturile conexe1
prevede la art. 33 alin. (1) lit. b) c ,,utilizarea de scurte citate dintr-o operd,
in scop de analizd, comentariu  sau critica ori cu titlu de exemplificare, in
misura   in care folosirea lorjustificd intinderea citatului este permisg, farg
a fi necesar nici consimthmintul autorului, nici plata vreunei remuneratii,
insg numai  cu conditia ca aceasti utilizare a operei sA fie conformi bunelor
uzante, sA nu contraving exploatirii normale a operei §i sa nu-1 prejudicieze
pe autor ori pe titularii drepturilor de exploatare.
    Lipsa reglementgrii acestui drept ar conduce la situatia in care autorii ce
doresc sA citeze o opinie deja exprimatg in doctring, fie pentru a confirma ori
