                  WAIVING  POINTS OF ORDER AGAINST THE CONFERENCE  REPORT TO AC-
                    COMPANY  H.R. 2862, SCIENCE, STATE, JUSTICE, COMMERCE, AND RE-
                    LATED AGENCIES APPROPRIATIONS ACT, 2006

                             Mr. GINGREY, from the Committee on Rules,
                                      submitted the following


                                         REPORT

                                       [To accompany H. Res. 538]
                    The  Committee on Rules, having had under consideration House
                  Resolution 538, by a nonrecord vote, reports the same to the House
                  with the recommendation that the resolution be adopted.
                             SUMMARY  OF PROVISIONS OF THE RESOLUTION
                    The  resolution waives all points of order against the conference
                  report to accompany H.R. 2862, the Science, State, Justice, Com-
                  merce, and Related Agencies Appropriations Act, 2006, and against
                  its consideration. The resolution also provides that the conference
                  report shall be considered as read.
                                      EXPLANATION OF WAIVERS
                    The  waiver of all points of order against consideration is nec-
                  essary because the conference report (H. Rept. 109-272) was filed
                  with the House on Monday,  November  7, 2005, and it may be con-
                  sidered by the House as early as Wednesday,  November  9, 2005,
                  which  would violate clause 8 of rule XXII (requiring a three-day
                  layover of conference reports and the accompanying joint explana-
                  tory statement).
