W. Bachelder,
At the October term of the Supreme Judical Court, the Grand Jury returned
a true bill of indictment against Joseph J. Sager for the murder of his wife.--
-'he prisoner was then arraigned and pleaded not guilty.
Clerk-How will you be tried?
Prisoner-By God and my country,
Clerk-God send you a good deliverance.
The Court assigned the 23d of this month for his trial. The prisoner was than
remanded to jail, where he has remained until the time appointed for his trial.
THURSDAY, Oct. 23, 1834.
The Court met at half past 9 o'clock, Judges Weston and Parris present.
The Clerk then proceeded to call the Jurors, one by one, alphabetically.
Empannelling the Jury.
It was ruled by the Court that the prisoner's Counsel should first question
each Juror and challenge for cause if any existed-if not the State's Attorney
would then proceed to ask questions,and then if not challenged for cause, the
prisoner might exercise his right of challenging peremptorily. Each man sworn
to make true answers to the questions put to him,
The questions proposed to each Juror were
1st. Have you formed or expressed any opinion as to the guilt or innocence
.of the prisoner ?
2d. Have you any bias on your mind ?
8d. (Asked by Attorney General,) Have you any conscientious scruples
against finding a man guilty of a crime punishable with death.

dlerk.-Juror look upon the prisoner. Prisoner look upon the Juror. The
Juror in answer to the questions proposed said that he had formed or expressed..
no opinion-had no bias, no scruples-sworn.

Franklin Barton, answered no to the enquiries; challenged peremptorily.
.ANsoa' BARTON, answered no to the equiries; sworn.
Nathan Blackman, same answers; challenged peremptorily.
Peleg Benson, Jr., same answers; challenged peremptorily.
John Eveleth, conscious of a bias; challenged for cause.
Francis Fuller 2d, answered the enquiries in the negative; challenged per-
mnptorily.
