This is an action commenced by a summons case, which
was duly served on defendants.
LEWIS WALN SMITH, of Philadelphia, JNo. SESSIONS, and
JNO. K. PORTER, of New York, for plaintiffs.
ENOCH L. FANCHER and NOAH DAVIS, of New York, for
the defendants.

The Ocean National Bank, defendant herein, a citizen of
the State of New York, incorporated by the name aforesaid,
under and in pursuance of the act of Congress entitled An
Act to provide a national currency, secured by a pledge of
United States bonds, and to provide for the circulation and
redemption thereof ; approved June 3d, 1864; and by au-
thority and in pursuance of an act of the Legislature of
the State of New York, passed March 9th, 1865, entitled
An Act enabling the banks of said State to become asso-
