STATEMENT.
The plaintiffs recovered judgment before a referee, in
an action of partition. The defendant appealed there-
from to the General Term of the Third Department,
and the judgment was there affirmed.    From  such
judgment of affirmance the defendant brings this appeal.
On the 29th day of October, 1821, William C. Hum-
phrey and wife, conveyed by deed to Samuel Hollen-
back, fifty acres of land, on Lot 66 in the town of Hec-
tor, then Tompkins, but now Sanyler County. Plain-
tie's Ex. A., Fols. 150 to 157.   And, on the 26th day
of November, 1821, Andrew Yates and wife, and Ann
Yates, conveyed by deed to said Samuiel Hollenback,
sixty acres of land on said lot 66 in the same town.
Plaintiff's Exhibit B., Fols. 176 to 183.
Between the foregoing two pieces there is a strip or
gore of land iatLconveyed by, embractd, or included, in
the description in either of the two deeds aforesaid.
