BRIEF STATEMENT.
This was an action of replevin brought by the re-
spondents against the appellant, Sheriff of Tompkins
County, to recover certain personal property seized on
execution against Andrus & McChain. The cause was
tried by and before Justice Follett, and a jury, at the
Circuit in Tompkins County, held in March, 1881, and
a verdict rendered in favor ot the respondents for the
possession of the property and damages for its deten-
tion, upon which judginent was duly entered in Tomp-
kins Coun1ty, March 25th, 1881. From this judgment
the defendant appealed to this court upon case and ex-
ceptions.
POINT I.
The Bill of Sale,Exhibit No. 1, Fol. 40, and Exhib-
it No. 2, Fol. 49, make one instrument and are to be
read and construed together.
