The issues in this action came on for trial hefore the
Hon. Wni. Murrav, one of the Justice-; of this Court, at
a Circuit Court held at Ithaca, in an(l for the ('oiuntv 4
Tompkins. on the 19th day ,, March, tsB77.
A jury was called and sworn, and the plaintiffs 1,Y their
counsel opened the ease.
The plaintiffs then, to maintain the isuec upon their
part, called as a witness the defendant, Julia A. Allen,.
who testified as follows :-
I reside at Mott's Corner,, and am the wife of John l1.
Allen ; I reside upon this property.
It was here admitted by the attornevs for the defend.
ant, that the defendant was and is now the owner in fee
of the real estate upon which the said mill in qne'stion is
situated.
I recollect the time the mill was repaired.  I do the
business and my husband works for me, under my direc-
tions. What I order him to do. He has to come to me to
make any bargain and does come to me when he makes L
all bargains. I desired to have the mill repaired, I told
