POINTS OF APPELLANT.
This is an appeal from an order requiring the defend-
ant to pay $50 to the plaintiff for counsel fee and expen-
ses. (Fol. 50-54.)
The action was brought to annul the marriage contract
between the parties, upon the ground that the defendant
had a wife living when he married the plaintiff. (Fol.
12, 13 and 34, 35.)
The venue of the acttion was originally laid in Steu-
ben county and the order appealed from was made in the
Fourth Department ; the venue, however, has since been
changed to Schuyler county, by an order of the Court.
