                    MOTION   FOR  LEAVE  TO DISPENSE
               WITH   PREPARATION OF A JOINT APPENDIX


      Pursuant to Rule 26.8 of the Rules of this Court, Petitioners Frederick L.

Allen and Nautilus Productions, LLC respectfully seek leave to dispense with the

preparation of a joint appendix in this case. The opinions of the United States

Court of Appeals for the Fourth Circuit and the United States District Court for the

Eastern District of North Carolina are included in the appendix to the petition for a

writ of certiorari. In Petitioners' view, no other portion of the record is material to

the Court's consideration of the question presented. I have consulted with counsel

of record for the Respondents, who agrees that a joint appendix is not necessary and

consents to this motion.
