MOTION FOR LEAVE TO DISPENSE WITH
PREPARATION OF A JOINT APPENDIX
Pursuant to Rule 26.8 of the Rules of this Court, the Acting
Solicitor General, on behalf of petitioners, respectfully seeks
leave to dispense with the requirement of a joint appendix in this
case.   The question presented is a question of law:    whether a
noncitizen detained under 8 U.S.C. 1231 is entitled by statute,
after six months of detention, to a bond hearing at which the
government must prove to an immigration judge by clear and
convincing evidence that the noncitizen is a flight risk or a
danger to the community. The orders of the court of appeals and
