       MOTION   FOR  LEAVE  TO  PROCEED   INFORMA PAUPERIS


     Pursuant to Rule 39 of the Rules of this Court, the Respondent, Jason Daniel

Sims, asks leave to file the attached Brief in Opposition to Petition for Writ of

Certiorari, without prepayment of costs, and to proceed in forma pauperis.

     Pursuant to Title 18, United States Code § 3006A (the Criminal Justice Act),

petitioner has previously been granted leave to proceed in forma pauperis in the

following courts: United States District Court for the Eastern District of Arkansas

and United States Court of Appeals for the Eighth Circuit. Petitioner is incarcerated

in the Federal Bureau of Prisons and remains indigent.
