Who Pays the Bill for the Unauthorized Private-School
Education of a Learning Disabled Child?
The Individuals with Disabilities Education Act (IDEA-). formerly known as the Education of the Handicapped Act,
guarantees every child in America. including a disabled child, a free appropriate public education. The purpose of the
IDEA is to ensure that children with disabilities, including learning disabilities. receive equal and effective educational
opportunities. But, what happens when the parent of a leaming disabled child believes that the State is not providing a free
appropriate public education for his or her child? Can the parent unilaterally place the child in a private school which is not
state-approved and then recover the costs of the private placement?

Title VII of the Civil Rights Act of 1964 prohibits sexual harassment when 1) it is made a term orcondition of employment or
2) it creates an abusive or hostile work environment Where sexual harassment is a condition of employment. the plaintiff
alleges a tangible injury - for example. being fired for refusing to date his or her boss. This case presents the question of
w% hether a plaintiff claiming that sexual harassment created a hostile work environment must allege that the harassing conduct
caused a tangible injury - for example, psychological harm.
Can the Government Seize Real Property
Without a Prior Hearing?
In this case, as in many other cases, the government presented evidence to a magistrate that Good's house was used in
illegal drug transactions. The magistrate. without notice or hearing. found probable cause to believe that the land was
forfeitable and issued a warrant authorizing its seizure. The Supreme Court is asked to decide if such seizures violate Due
Process Clause principles of notice and an opportunity to be heard.
