Bagchi,* Elizabeth Banker, and Ife Ogunleye*** Abstract Online spaces have undoubtedly played a significant role in facilitating discourse and the exchange of information. With this increased discourse, however, digital platforms have also seen a rise in harmful or problematic content shared online-including health misinformation, hate speech, and child sex abuse material, among others. Many commentators have put the blame for this trend on Section 230, arguing that Section 230 has enabled the Koustubh K.J. Bagchi is Vice President of Technology Policy at the Chamber of Progress. He has over a decade of experience in public policy and legislative strategy at the local, state, and federal levels. In addition to advising members of the Washington State Senate, he worked as Legislative Counsel for a D.C. City Councilmember and a Member of Congress who served on the influential House Appropriations Committee. After his public service career, he spent time working in civil so- ciety, including a national civil rights organization. K.J. graduated from the University of California Davis and received his law degree from Seattle University School of Law. Elizabeth Banker holds a J.D., summa cum laude, from Catholic University of America's Law School. She has held legal and policy roles at Yahoo!, Twitter, and Google. At the time of drafting, she was Vice President of Legal Advocacy at the Chamber ofProgress. Ife Ogunleye is a manager in BSR's tech and human rights team. She has several years of experi- ence in a variety ofprivacy, tech, and artificial intelligence (AI) policy issues and advises companies on the human rights impacts of their products, services, and business operations. She also previously worked as an attorney, providing legal advice to multinational companies in the extractive, energy, telecommunications, and financial technology industries on mergers, acquisitions, and financings as well as conducting anti-corruption, money laundering, and fraud investigations. Ife began her career as a policy analyst working on privacy and consumer protection issues in the UK and Europe. Ife holds a Master of Development Practice from the University of California, Berkeley and a law degree from the University of Manchester, England. 1
