ALCOHOL MANUFACTURERS AND SUPPLIERS,

FETAL ALCOHOL SPECTRUM DISORDER, AND

                 THE DUTY TO INFORM

All manufacturers and suppliers have a
general common law duty of care to inform
consumers of the risks inherent in using
their products. Moreover, the Canadian
courts have established a demanding stan-
dard of disclosure for products intended
for human consumption, especially if they
pose a significant risk of serious bodily
harm or illness. Although these principles
were clearly set out almost 40 years ago,
alcohol manufacturers and suppliers have
not yet been held accountable for failing to
inform consumers of the risks of Fetal Alco-
hol Syndrome Disorder (FASD), the leading
cause of birth defects, cognitive impairment

duits. En outre, les tribunaux canadiens ont

tion humaine, plus particulierement, si les-
dits produits engendrent un risque important
de lesions corporelles graves ou de maladie.

toujours pas tenus responsables du devoir
d'informer les consommateurs des risques
