Editorial




As joint Editors of the Journal we would like to wish all our readers a very happy
and prosperous  New  Year. We  also await with interest the receipt of articles
relating to the Government's new  Social Security Benefits policies and would
like to emphasise our interest in receiving contributions not only from all parts
of the United Kingdom  but from  our very wide spread readership all over the
world. The Journal has a considerable readership in the Far East, Australasia, all
over Western  Europe and Africa and over both continents of the Americas and
in Ireland. We would also like to take the opportunity to thank all of the referees
who  have acted for us in the past year and those who are continuing to act for
us.
   In this first issue of 1998 we have articles on a wide variety of topics. The first
article by Julia Brophy on 'The position of parents using experts in care proceed-
ings -  a failure of partnership', focuses on the position of parents in care
proceedings following the implementation of the Children Act 1989, in October
1991. The  article examines the process of expert evidence acculmulation and
demonstrates that this process has disadvantages for parents. To an examination
of the  views of  the guardian  ad litem, it locates many  of  the problems
experienced by parents, firstly in the quality of legal representation many receive,
secondly in their subordinate position in the process of evidence accumulation
and thirdly in the subsequent instruction of certain experts frequently commis-
sioned on their behalf. Brophy points out that in the absence of attention being
given to the position of parents, attempts to reduce the number of experts in care
proceedings may  well exacerbate many of the problems identified in the article.
This is likely to have adverse consequences not only on the effectiveness of the
guardian but also on the willingness of parents to work in partnership with Local
Authority's in the implementation of a care plan.
   In the article by Graham Moffat - 'Occupational pension schemes, equality
and Europe: a decade of change', the author draws on a wide range of published
survey data, examining the extent to which equal treatment has been introduced
into the rules and practices of the 100,000 plus occupational pension schemes in
the UK. Moffat also considers the nature of the changes, whether these have been
influenced by development in EC law, and some distribution implications of the
changes for present and future scheme members. The article argues that EC law
acted as an important catalyst in accelerating an equalization process that for
various social, economic and other legal reasons was already underway in some
occupational pension schemes. It is suggested, however, that influence of EC law
on the way in which equal treatment has been introduced can lead to detrimental
consequences for some members  of occupational pension schemes. Again, in the
light of the current Government's consideration of the arrangements being made
for pensions, Moffat's article is a timely contribution to that debate.
