The 2024 issue of the Cape Town Convention Journal follows the 2022 and 2023
annual conferences held in Cambridge under the auspices of the Cape Town Convention
Academic Project. As in the previous years, the format of the conferences was designed
to facilitate intensive discussion, with a presenter (the author or co-authors of the
paper) and one or more commentators. We were joined by senior academics, practi-
tioners, representatives of international organisations and other officials, who offered
their insightful comments and enriched the debate.
This issue offers thoughtful and engaging analyses of the Cape Town Convention
(the 'CTC', 'Convention') through the lens of public international law ('PIL'), offering
a rare and hence especially valuable perspective on the CTC. Philippa Webb reflects on
the relationship between the Convention and the law of state immunity. Andrew Sanger
explores the complex interaction between private property rights and public interna-
tional law. Jack Wright Nelson extends a PIL concept of 'community interests' to the
CTC to facilitate the integration of the Convention in mainstream public international
law. All three authors tackle from different angles the difficult challenge of enforcing
the provisions of the Cape Town Convention in the event of non-compliance of states
parties with their treaty obligations.
Donal Patrick Hanley provides a useful multi-faceted overview of the CTC from the
perspective of international aircraft leasing practices.
In line with the previous issues, the current issue includes a Depositary Update
prepared by the UNIDROIT Secretariat. I am deeply grateful to the entire UNIDROIT
Secretariat, and in particular Marina Schneider, for this excellent work.
