Subject: Federal Trade Commission: Combating Auto Retail Scams Trade Regulation Rule

Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a major rule
promulgated by the Federal Trade Commission (FTC) titled Combating Auto Retail Scams
Trade Regulation Rule (RIN: 3084-AB72). We received the rule on March 19, 2024. It was
published in the Federal Register as a final rule on January 4, 2024. 89 Fed. Reg. 590. The
rule has a stated effective date of July 30, 2024. However, in its submission to us, FTC stated
that the effective date of this final rule is currently stayed pending court proceedings.

According to FTC, this final rule is related to the sale, financing, and leasing of covered motor
vehicles by covered motor vehicle dealers. FTC stated that the final rule, among other things,
prohibits motor vehicle dealers from making certain misrepresentations in the course of selling,
leasing, or arranging financing for motor vehicles, requires accurate pricing disclosures in
dealers' advertising and sales communications, requires dealers to obtain consumers' express,
informed consent for charges, prohibits the sale of any add-on product or service that confers
no benefit to the consumer, and requires dealers to keep records of certain advertisements and
customer transactions.

section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the rule. If you have any questions
