The message was transmitted to the Congress pursuant to the Impoundment Control Act of 1974. It includes -hree re- scission proposals concerning education programs -f -t:e Depart- ment of Health, Education, and Welfare (HEW), one rescission proposal affecting the child nutrition procrar- adoinisterec by the Department of Agriculture, and four new deferral cro- • oosa 1 s. •.The budget authority the President proposes -o rescind and defer has been withheld since July l--27 da ,' before the pioposals-were reported to the Congress. IVe e1.ei=ve the President should have reported these withholdi.ns of buzet authority promptly, and his failure to do so ci not compl.•v . with the reauireme t.s of the .Impoundment Control Act that impoundments be brought to the -attention of he ..Cncress- whenever the President determines to withhold such authority. . Concerning the proposed rescissions, the late reporting of these withholdings is particularlv troublesc-e because it may operate to deny to the Congress the expect.ed cornsecuence of its rejecting a- rescission proposal--the full and pruden- use of the budget authority. Specifically, the !a-e repcrting of the proposed rescission delays the date upon which the 45- day period prescribed for congressional action on rescission proposals begins to run. Based on the current conaressional schedule, the 45 days of continuous session will end on Seo- tember 29, 1976. Thus, if the rescissions are rejected bv the Congress, budget authority will be reouireJ to be made available on September 30, 1976. Only one da, will remain to obligate the budget authority for the annual funds (Fiscal Year 1976 and Transition Quarter) involved in two of the three EEW programs.
