   Dear Mr. Chairman:

        This responds to your April 1, 1986, request for commentq
   on S. 2198, which would provide that benefits payable in
   calendar year 1987 under programs listed in section 257(l)(A)
   of the Balanced Budget and Emergency Deficit Control Act of
   1985 (Public Law'99-177) would not be subject to suspension or
   reduction under an order issued by the President under the Act.

        Public Law 99-177 currently includes a number of
   exemptions, exceptions, limitations, and special rules to
   protect a. number of specified accounts, in whole or in part,
   from the automatic reduction process. The drafters of the
   statute made case by case determinations as to which accounts
   should b'e included among the list of those exempted or
   protected, based upon factors relating to policy and equity.
   S. 2198 would, in effect, expand that list to include a
   designated portion of programs subject to reduction of
   automatic spending increases. The need for such an amendment,
   in our view, is a policy determination best left to the
   judgment of the Congress.
