of America, protesting asaizt rejection of your bid under Speci-
fication mo. 2000-856, for the paving of the stapede Du Access
Road, Washce Project, 13nmat-Cmzfornia, irsued by, the Bureau of
Reclamation, Deprtment off liyterior, Sacramnto,, Califtornia.

     Under the imstant Invitaton~ for Bids (iM), three contractors
s u1bitted bids with flevadft PaVing ConmAry (newvaa) being the apparent
low bidder. However, the bids of Nevad Und the two other bidders
were all rejected for being nonreaponiwe in failing to comply with
the Equal Employmnt Oportunity ana Affirmative Action requirements
of the MY.

     The contraet was to be ,pertf'red. in the geogaphic area subject
to the Greater Sacrananto Area Plan, The IM contained the Eqw4.l
Ersyment Opportunity Aff-xM   tIve Action Requirements Bid Conditions
vhich consisted of Parts X and 11. Part I applied to- -those bidders
who were sigmtories to the Greater Saeramento Plan, and Part II
applied to biddes who were not signtories to the Plan. Nom of
these bidders were 4inatories to the Greater Sacrazento Area Plan
and therefore, ~si we-re subject to Part n of the Bid Conditions.

     Part U required that a bidder submit with 1his bid. an affiroatiie
action Plan. The Plan must -set forth Eoals anad timetables or minority
