      The record reveals that            , permanently stationed
 at Lincoln, Nebraska, traveled from that city to Monterey and
 Los Angeles, California to attend a Soil Scientists Meeting and
 Training Session during the period December 1, 1975, through
 December 5, 1975. Upon completion of this assignment he proceeded
 to San Diego, California for personal reasons, returning to Lincoln
 from that city, by way of Denver, Colorado. He was delayed several
 hours in Denver due to an overbooked flight. The common carrier,
 United Air Lines, paid             $52.78 representing denied
 boarding compensation. The check for this amount was made out to
             , at the insistence of the carrier. In accordance
.with Federal Travel Regulations 101-7, paragraph 1-2.5(b), he re-
imbursed the United States Government the amount of $7.00, representing
the difference between direct and indirect return flight route costs.
              requests that he be allowed to retain denied boarding
 compensation paid to him by the airline. FOMR 101-7, paragraph
 1-3.5(b) is quite specific in such cases. Tie regulation states
 in part that

            Penalty payments made by air carriers under
            certain provisions of their tariffs for
            failing to furnish accomodations for con-
            firmed reserved space are due the Government
            and not the travker when they result from
            travel on official business.

                 L argues that, since his per diem allowance terminated
 on December 5, 1975 and he was returning to his permanent station
 by an indirect route, on a non-working day (Sunday, December 7, 1975),
 paragraph 1-3.5(b) should be inapplicable in tis instance.
