Dear Mr. MoUohan:

      I hiis is in response to your letter to the Director of our
Office of Conressional Relations forwarding correspondence frorm
Atre.               , on which you request our comment. Mlrs.
refers to a report in the New York Times concernLg  aymient
by the Federal Government of the legal expenses of former Central
Intelligence Agency Director Richard Helms. Mrs.    asks
that we determine if the Government made such an expenditure.
he questions the justification for MaINg the explenses as reported
in the Times article. and shze asks, If we find tt such payments
were made, that we determine the propriety of the alleged expendaiture.
      Although it is not entirely clear from MV-r.,  letter.
her concern appears to be primarily with representation of Mr. Ueinsm
in connection with Federal criminal charges against hi=. Mr. Feirn
pleaded nolo contendere to two misdemeanor counts of failing to
testify totat gressiial coimittee Mly, completely, and accurately.
tie is also beinG sued in several civil actions over conduct undertaken
by him as Director of Central intelligence.
      The Departmeat of Justice has informed us by letter that
it has not expended any funds to retain private counsel to represent
Mir. Helms in Federal criminal proceedings, and that to do so would
be againt Department policy. Xu addition, the Department says
that it has expended funds to retain private counael to represent
mr. Helms in the civil actions arising from activities by ;r. Hehns
within the scope of his employrnent as Director of Central Intelligence.

      The Justice Department letter indicates that the uanda uaed
to pay Mr. Helus' legal expenses were chargedagainat an appropri-
ation to the Justice Department of $4 860 000 which Congress
provided for Salaries and Lp1.es-General Legal Activity.
Pub. L, No. 95-26, 91 Stat. 8   %i, May 4., 1977. These AiMds were
appropriated for the specific purpose of paying the private counsel
fees required for civil auits against present and former Federal
employees which had begun at the time that the appropriation was
enacted. The conferees stipulatd, however, that none of these
funds were to be available for use in suits commenced after the ef-
fective date of the Act until the appropriate cotrnittees of Congress
have reviewed the Attorney General's policy of providing such
