Dear Ar. Sisk:

       is is in reply to your request that we revieu certain elements of
the Water Quality Information ExchanZe Program conducted by the Environ-
mental Protection Agency (EPA). Of special conceru is a series of vews-
letters entitled Water Quality Awarentese, published by the Planning and
Conservation Foundation, a California nonprofit organization, under EPA
Purchase Order PS-Ql-295&-A. As part of the Procurement Plan incorporated
in thm Purchase Order, EPA agreed to furnish the Foundation with letter-siZe
penalty %ailing envelopes endorsed at the third-class bulk rate, in twhich
to mail the newsletters.

     Pertinent areas of inquiry, as established in your letter and in suo-
sequent contacts with membars of your staff, are*   PA's justification for
entering into the contract with the Vosndationp EPA's auttiorlty to provile
the penalty mailing envelopes; coat comparison of penalty mailing envelopes
wita available alternatives; use of language in the neusletters indicating
approval cy SPA of their preparation; and possible violations of Federal
anti-lobbying statutes ia certain articles of an advocacy nature.

     ZPA documents indicate that the Water Quality Information Ezchange
Program was conducted pursuant to section 101(e) qf the Federal 2atar Pollu-
tion Control Act, as azended, 33 U.S.C. S 125l(  $upp. IV, 1974), which
establishes as one of the goals of the Act, that-

           Public participation in the develpuant, revision,
     and enforcement of any regulation, standard, effluent
     limitation, plan, or program established by tha Adudnias-
     trator or any State under this chapter shall be provided
     for. encouraged, and assisted by the Aministrator and
     the States. * * *'
