    on November 3, 1965, your !Deuat Postmaster General requested our dec-
ejO construing 39 U.5.Code 3573, as amended y section. 5(b) of the fedeal
smployees salas Act of 1965, Ptb. L. 89-30j 79 Stat. 1114, reading in part
as follows:
         (a) In emergenies or if the needs at the service nqure,
     the Postmaster General w requlire employees to perform overtUn
     wrk or to work  n  oliay. Overtias work is any work offl-
     cia-ly Wm l or approed which is performed by-

              (I) an nual rate regular eml@oyee In excess of his
         resular work schedule,
              ufla) a bourl7 rate replar employee in noses of
         eight -hous In a da or forty hours In a wek, and

              (a ) a substitute emploee In excess of fort4 hours
          In a week.


          (b) For each hour of overtime work the Postoster General
     shall ccapesate $a employe In the 'PS' Sbhfle as follow:
              (I) Be shal pes each employee In or below salary
          level 11-T eupensatiwa at the rate of 15 per centia of
          tbh        Jourly , rte of basic ccpensat4on for his level ad
          step cmpute4 by dividing the scheduled anwa. rate of
          basic compenation by two thousand and eighty.'

               (2) He shall rant each employe In or abon salary
          level rn-8 ompensatory time eoqual to the ovrtime worked,,
          or in his discretion 1A lieu thereof pay sach epyee com-
          peasation at the rate of 150 per centm of the hourly rate
          of basic compensation of the enplaM or of the hourly rate
          of the basic ccmpensation for the highest step of salary
          level J8-T, tiobever Is the lesser.
