 MATTER OF: A.B. Dick Company--Reconsideration

 DIGEST:

GAO will not reconsider a prior decision ren-
dered in response to an expression of interest
from a court unless the court expresses an
interest in the reconsideration of the decision.

A.B. Dick Company (A.B. Dick) requests reconsideration
of our decision in A.B. Dick Conipany, B-211119.3,
September 22, 1983, 83-2 CPD 360. That decision was ren-
dered in response to an expression of interest from the
United States District Court for the District of Columbia in
connection with Civil Action No. 83-1610.

It is our policy not to decide matters where, as here,
the material issues are before a court of competent juris-
diction. io wever, if the court expresses an interest in a
decision by our Office, we will then consider the matter oni
the merits. John Carlo Inc.--Reconsideration, B-204928.2,
March 31, 1982, 83-1 CPD 1.

In the present case, the court did express an interest
in our decision. A.B. Dick requests that vie reconsider the
decision. However, since our prior decision was issued in
response to an expression of interest from the court and the
court has not indicated any interest in our reconsideration
of the prior decision, we will tahe no further action on the
merits of this matter. Biosnherics, Inc.--Request for
Reconsideration, B-203419.3, January 22, 1932, 82-1 CPD 48.

We dismiss A.B. Dick's request for reconsideration.

                             Harry -,. Van Cleve
                             Acting General Counsel
