                            THEi COMPTROLLER GENERAL
   DECISION OF THE UNITED STATES
                            WASHINGTON. O.C. 20548

   FILE: B-210135.2 DATE:February 23, 1983

   MATTER OF: C.W. Girard, C.M.--Reconsideration

   DIGEST:
        Request for reconsideration of protest
decision filed more than 10 working days
        after protester receives decision with
        which it disagrees is untimely.

C.W. Girard, C.M. (Girard), requests reconsideration of
our decision in C.W. Girard, C.M., B-210135, January 10,
1983, 83-1 CPD , wherein we dismissed Girard's protest
against specifications used by the Department of Justice in.,,
solicitation No. JL USA-83-B-0001. Girard essentially
disagrees with our decision.

Girard's request for reconsideration is untimely.

     Our Bid Protest Procedures, 4 C.F.R. § 21.9(b) (1982),
require that requests for reconsideration be filed within 10
working days after the basis for reconsideration is known or
should have been known.

Girard's request, however, was filed on February 7,
1983, 20 working days after issuance of our decision. We
assume that a protester will receive a decision not later
than 1 calendar week after its issuance. See King-Fish
Company - Reconsideration, B-205003.2, July 28, 1982, 82-2
CPD 87. In this case, Girard should have received our deci-
sion by January 17, 1983. Since the reconsideration request
is based on disagreement with our decision, it should have
been filed by January 31, 1983. Since the request was not
filed within the 10 working day period provided for under
our Bid Protest Procedures, it is dismissed.
