MATTER OF: Bernard Lo Singer Real Estate-Sales
               Expenses
 DI3EST:
An employee of the DePartrent of,.the
Air Force claims reimbursement for real
            estate.e;xpenses incurred in selling his
            residence in Grand Island, Nebraska,
incidehtto a permanent cJ)ange of sta-
            tiont~rom Peterson Air Foj:ce Base,
Colorado, to Offutt Ajr Force Base,
            Nebraska,- This residence) $however, -was
not the one frot-which he' regularly
commuted to and.from work' Rather, the
employee l'ived in a mobilii hometfrom
which'he'c6mmuted, to work 'at Peterson and
from which he visited his !family in Grand
            Island,. Nebraska, on weekends, Employee
            has-thus not fulfilled requirement of
Joint Travel Regulations that in order to
be entitled -to reimbursement of expenses
of sale of residence at former'duty rta-
tion, he must have commuted to and from
            work from that residence. Accordingly,
            claim is denied.
Thisis inresponse to a request for an advance
  decision from -Lieutenant Colohel J,:Greenstreet,-Chief,
Accoihting and.Finance& BrdnchOffutt Air Force Base,
Nebraika, concerhing whether Mr. Bec-nard L,. Singer, a
civilian employee of the Departmen t of Defense, may,-be
reimbursed for i:eal estate exPensesincurrdo incident
to a permanent,,change 6fstatibn. ..The only issue in-
volved.,is whether iMr.Singer is entitled to reimburse-
ment Og' real estate expefises incident to the sale of
a resid!ence in-Grand Island,;; Nebraska, to which he
commuted o 4y on weekends. We conclude that the
expenses d6, selling the residience in Grand Island,
Nebrasia, may not be reimbursed to Mr. Sihger because
the property sold was not the residence from which he
regularly commuted to and from his former duty station
  as required by regulations.
