 MATTER  OF: Sea-Land Service, Inc.--request for
             reconsideration

       Absent additional specific expression of
       interest from court, GAO will not reconsider
       decision rendered in response to initial
       specific expression of interest from court.

     For the second time, Sea-Land Service, Inc.
(Sea-Land), requests reconsideration of our decision
in the matter of Foss Alaska Line, 57 Comp. Gen.
(B-192149, September 12, 1978), 78-2 CPD 192. That
decision was rendered in response to an expression
of interest from the United States District Court for
the District of New Jersey in connection with civil
action No. 78-1223, entitled Sea-Land Service, Inc.
v. Brown, et al.

    Sea-Land's initial request for reconsideration was
dismissed--without consideration on the merits--because
the court had not indicated an interest in our Office
reconsidering the decision and absent such an additional
expression of interest, it is our policy not to decide
matters where, as here, the material issues are before
a court of competent jurisdiction. Sea-Land Service, Inc.,
B-192149, October 16, 1978, 78-2 CPD 278.

    Sea-Land argues that the September 12, 1978,
decision should be reconsidered because (1) it did
not consider the merits of two bases of protest which
were determined to be untimely, and (2) it contained
errors of fact or law.  But Sea-Land offers no infor-
mation, either new or not previously considered, to
indicate that the court expects our Office to recon-
sider the merits of the matter or to further explain
our prior decision.
