          MATTER  oF:LeRoy A. Ellerbrock - Per diem for
C                    travel incident to transfei4.

          DICES1; Employee who performed travel incident to
                  transfer of station was delayed by breakdown
                  of rented truck used to haul household goods.
                  On basis of such dilay, he claired 4-1/2 days'
                  per diem. Employee's entitlement '.is rnquired
                  to be determined.puisuant to 2TR para. 2-2.3d(2),
                  which sets maximum reimburaement for per diem
                  on baEis of minimum driving distance per day
                  which is prescribed as reasonable and is nct
                  less than tverate of 300 miles per calendar
                  day. Since distance employee traveled was 663
                  miles, he is entitled to per diem for a maximum
                  of 2-1/4 days.

             This action is at the request of Mr. H. Larry Jordan,
        an authorized certifying officer for the Depart.ent of
        Agriculture. Mr. Jordan submits the reclaim of LeRoy A.
        E1lerbrock for additional per diem allowance incident to
        his travel from Ithaca, New York, to Chicago, Illinois,
        due to his perAanent change of station.

             Mr. Jordan reports the facts of this case as followes

                  On November 29, 1976, at 8:00 A.M.,
                  Mr. Ellerbrock left Ithaca, New York,
                  driving a U]-Haul Truck, enroute to
                  Chicago, Illinois. At 5:30 P.M., he
                  arrived at ftadonia, New York. By
                  letter dated February 23, .1977, the
                  New York State Thruway Authority
                  advised that they cl6sed the thruway
                  on which Mr. Ellerbricck was traaling,
                  from 7:12 P.M., Ndvember 29, 1976,
                  until 7:45 A.M., November 30, 1976.
                  On November 30, 1976, Mr. Ellerbrock
                  proceeded to Cleveland, Ohio, where the
                  U-Haul truck he was driving broke down
                  and had to be towed to a garage for
                  repairs. He remained in Cleveland
                  overnight and proceeded on his way
