MATTER D-: Mississippi's matching contributions to the
               lationrl School Lunch Program


DIGEST:


Due to the large number of free and reduced-price lunches
served and the low coat of preparing the same, the State
of Mississippi did.not neat Federal miatching requirement
mandated by the National School Lunch Act (42 U.S.C.
* 1751 et sa.),  for fiscal year 1975. Since the Conrrees
ha. subsequently enacted leXai4,.tion which vould prevent
the reoccurrence of this prmolen and since a contrary
reeult vould withhold from the State those Federal funds
to which it would otherviue have been entitled, we vill
not object to the Departmext of Agriculture's deternina-
tion not to require repaymnt of 1975 funds in order for
HMississippi to comply with the matching requirements of
the Act.


     Tis  decision to the Secretary of Ariculture is in response to
a submission by Assistant Secretary Richard L. Feltner setking our
concurrence to the Department's proposal to valve the Stace of his-
siAitppi's obligations unlder the Uational School Lun'zh Program.

     In this eubmission the Assistant Secretc.ry advises that?

     'The Mississippi State Educational Agency, in th@
     adminietration of tho iational School Lune- Progria
     in that State, failed by $2,752,460 to meet P.
     State-to-Federal natching requirement of the pro-
     gram for fincal yoar 1975. Because o! a set of
     condit.ona uniqua to Mississippi, it is the only
     State that did not meet this reqiirenent. Section
     210.6(i) of the USDt's Food and Nutrition Servicae
     regulationo (7 CFR Part 210) governing this progrsnL
     requires that a State must return the amount of
     funds under this matching requirement thac it fails
     to vntch. In this instance, that amount would be
     $1,284,023. We receaoend -or rencons presented in

     Mississippi failed to meet this matching require-
