     Consideratia  has been g.ven to letter of January 10, 1946,

from the formr  Secretary of the Interior, as follows:a

     uAuthority to acquire lands for the Geological Survey is ncw
vested in the Secretary of the Interior pursuant to the Aot of December
24, 1962 (56 Stat. 1086j 4) U. S. C., Supp. IT, .es. 36b) which
prenides, is part, as follows
     ahat  the  :ecretary of the Interior asy, on behalf of the
Unaited State and for use by the Geological Survy  in gaging streas,
acquire Iade  by dtoaticn or when finds have bee  appropriated by
Congress by purchase or coademation  but not in excse  of ten acres
for any one atram-gaging  station.  For the same purpoe  the Gecretary
may obtain easmeats,  licemse,  right st-f-way, and leases limited to
run for such a period of time or tern of years as may be required for
the effective performance of the function of gaging streams  * * **'

     9fhe Geological Survey propesee to acquire permanent easements
under authority of the above-quoted act for the coastruction of stream-
gaging stattene and, were  neesry, rights-f-ay for ingries to
and egress frew awh  statices.  The stations will be used throughout
the  United States by the Survey is the systematic colleotice of
continuous recowds of river diseharges at various atreas  and bodies
of water.  Hesrtofore, whe   it has ben  necessary to utilize privately-
aoned land for gaging station sites, the Survey has obtained access
to ruch aites by entering into leoes,  each leas  being limited to
the fiscal year In which it was entered into but subject to raneual
fram year to Aear.  This practice was authorized by your leciien
A-24745 of October 12, 1928.  The costs oa such leass  are being
charged against the appropriation item, 'Gaging streas.

     nThe questin  has now arises as to the proper charging of costs
incurred in connection with th  recent purchase o? several eaements
for streargaging  station sites.  The appropriaticm item 'Gag1ng
streams,' contained in the Interior ?epartment's appropriation act
far the fiscal year ending June 30, 1946, Pubile Law 123-79th  Congress,
