Dear Colonel Reilly:

     This refers to a request  for advance decision.from Captain J. S.
Goetz, USAF, Accounting and Finance Officer,  Headquarters Sheppard
Technical Training Center  (ATC), Sheppard Air Force Base, Texas.  The
request was assigned PDTATAC Control No.  80-26 by the Committee.  The
question  involves the amount of per diem payable incident to an evacua-
tion when te  member's family goes  to a designated place and resides in
a two-bedroom apartment in  the basement of the member's uncle's house.

     While ordinarily the Comptroller  General would consider questions
like that presented, it appears  that under paragraph M12007-5-b of
Volume 1,,'Joint Travel Regulations, no entitlement to per diem incident
to an evacuation exists.  That  regulation provides that when residence-
type quarters are occupied at  a designated place the allowance will
terminate.  The facts presented  show that residence-type quarters
were occupied3

     We are returning the  submission to you for further considera-
tion and any information you can provide explaining why an entitlement
might exist.  In the circumstances we  do not think a response to the
Accounting and Finance Officer's  request is appropriate at this time.
