Dear Mr. Chairman:

In response to your request, we are pleased to provide our
views on the portions of Title I of S. 1975, the
Comprehensive Federal Law Enforcement Improvements Act of
1987, which pertain to the investigative authority of the
Comptroller General. We will also comment on Title II of
S. 1975, which provides that the Comptroller General is to
serve as Chairman of the National Advisory Commission on Law
Enforcement.

In general, Title I contains a number of provisions intended
to enhance the ability of this Office to respond to
congressional needs for expeditious investigation of fraud,
abuse or other matters related to federal activities that
may involve violations of criminal or civil law. Except for
the portion of section 105 which would authorize the
Comptroller General to compel testimony of persons outside
the government, we endorse passage of these provisions.

The provisions which relate to our investigative authority
are contained in sections 105 through 109 of the bill.
Section 105 would amend section 712 of title 31, United
States Code, by adding a new subsection (b). Paragraph
(b)(1) authorizes the Comptroller General to assign General
Accounting Office (GAO) employees to conduct special
investigations of possible violations of crimina' and civil
statutes committed incident to federal programs and
activities. Paragraph (b)(1) complements, and reaffirms,
this Office's present authority to investigate potential
criminal matters related to federal programs and
activities.

In its current form, paragraph (b)(2) generally provides
that in conducting authorized investigations, the
Comptroller General may require by subpoena the attendance
and testimony of any private person or any agency officer or
employee. The provision also authorizes this Office to
