To the President of the Senate and the
Speaker of the House of Representatives

This letter reports on the status of budget authority that
the President proposed for rescission in the fifth special
impoundment message for fiscal year 1993, dated April 20,
1993, but for which the Congress has not passed a rescission
bill as defined in section 1011(3) of the Impoundment
Control Act (the Act). As we informed the Congress in our
report on the fifth special message (GAO/OGC-93-7),
submitted to the Congress on June 4, 1993, the Office of
Management and Budget (OMB) did not withhold from obligation
the budget authority proposed for rescission in the fifth
special message. The proposed rescission is set forth in
the enclosed listing submitted by the President with his
fifth special message.

Section 1012(b) of the Act requires that funds proposed for
rescission be made available for obligation unless the
Congress completes action on rescission bills within the
45-day period of continuous congressional session following
the day such proposal is received by the Congress. For the
rescission proposal submitted in the fifth special message,
the 45-day period ended on June 14, 1993, without the
Congress having passed such a bill.

We have confirmed with OMB that all funds proposed for
rescission are available for obligation.
