         The Department of Labor must ca.tify that there are no
domestic faruworkers availab1.e in the United States before the
Immiqration and Naturailation Service will permit foreign
workers to enter the co.intry temporarily. Regulations were
isstrd effective April 10, 1978, to define more clearly the
respective roles of the Department of labor, State Employment
Service agencies, and employers in the certificaticn process.
The practicality of the revised regulations cannot be assesred
until the parties I.ivolve.! uave had a chance tc work under tLem.
The primary function of the amjloyment Service is to provide
employers with workers ard workers with jobs. Growers felt thAt
the Employment Service d d not provide a sufficient numer of
qualified workers and th.t many of the 5orkers who were referred
did not last through the harvest season. The growers alsc
believed that there is generally an insufficient Lumber cf
domestic workers available. The Department of labor's
regulations require that a nationwide lakor search ke ccnducted
before the entrance of temporary alien workers into the United
States is permitted. However, regulations for the certification
of aliens seeking permanent employment require cn)T that a local
labor market search be conducted. The difference in the search
requirements reflects the languagi of the Insigraticn and
Nationality Act. (RRS)
