Reference is made to your letter dated April 4, 1973, and prior
correspondence, on behalf of Byrnes Distributing, 1. (Byrns), pro-
teting apninut the rejection of Bynes low bid as nonrmeponsive
under invitation for bido 141613-73--0019, issued by the Department
of the Air Force, Carswell Air Force Base, Texas. I have been
informally advised by the Air Force that the contract was awarded to
Carrier-Bock Company (Carrier) ou April 6. 1973.
The subject uclicitation, Inued on Lecember 15, 1972, pinvited
bids for supplying four to seven air-cooled condensing units and
spectified a deoired delivery within 30 d-7ys and a required delivery
within 45 days after the date of receipt o. delivery order. Bids'.
were opened on Jnnuary 31, 1973. Deneath the required delivery
schedule was a section, which was to be completed by the bidder,
entitled Biddero Proposed Delivery Schedule, It provided as
follows:
Dlivery ithin days after receipt of delivery
order,
Byrnes filled in the blank space in the following manner:
Delivery within 45 tc 60* days after the date of
reeeipt of deliwary order.
*telivery subject to prior sale or uanufacture[r]s
production at time of order.
The contracting officer rejected Byrnes' bid as nonreoponsive because
of a failure to corform to tho required delivery slcWdule set forth
in the olicitation.
