              Raoference is made to your telegram of Ncember 27, 1972,
         protesting thn rejection of your low bids on certain threaded
         plugs for tubes in invitatiow for bids DSA70-73-Bm09C7 and
         .1026, issued by the Defense Construceion Supply Center,
K .      Co imbus, Ohio.

              Both solicitattone provided that uward would be nade only
         for end items that had been tested and qualified for incluuion
         on Qualified Products List (QL) 18280.21 by bid upenLfg. In
         the spaces provided in both bids for the nine of the item and
         the test number of the qualified product offered, you entered
         Plug and il-F-18280. You also statti that your plant
         ould be the place of manufacture. As you were not lisrtd on
         the qPL, the cottracting officer contacted the facility responsible
         for furnishing QPL information and was advised that you had taken
         no action to become qualified for listing. As a result, your bids
         ere rejscted am nonresponsive.

              You have protested against the rejection claiming (I) that
         the itemas nru simple machined part that should not have been
         procured on a QPL basis and (2) that in any event under our
         decision 11-169290. June I 1970, you should have been allowed
         to qualify for the tqL after award.

              With respect to the first contention, rection 20.2(a) of
         the Interim Bid Erotest Prncedures and StaAardsprovides that
         protests based upon alleged improprieties in solicitations which
